Posting of the Draft Cosmetic Pesticide Ban Regulation

Dear Friends,

As you know, on June 18, 2008, the Cosmetic Pesticides Ban Act was passed in the Ontario Legislature.

I am proud of this Act because it takes a prudent approach to reduce potential risk, especially to the most vulnerable members of our society, from the cosmetic uses of pesticides. Cosmetic uses are unnecessary and there are alternatives to conventional pesticides to manage pests on lawns, and in gardens and parks.

Over the summer, our government consulted with stakeholders about the specifics of the ban. During the development of the draft regulation, consideration was given to the specific products proposed to be banned for sale and use.

The Ministry of the Environment has developed a draft regulation, which was posted on the Environmental Registry (EBR Registry Number: 010-5080) on November 7 for a period of 45 days. In particular, the public is being asked to comment on:

  • the proposed lists of pesticides (products and ingredients) banned for use and banned or restricted for sale;
  • the rules for pesticide use on golf courses; and
  • the exceptions to the ban for public health or safety reasons.

It is proposed that the province-wide ban would take effect in spring 2009, once the regulation is finalized.

We should stay the course regardless of any NAFTA challenges, by Dow Chemical and other chemical giants. They have no business to interfere in our internal affairs, the nasty Chapter 11 of NAFTA notwithstanding. Our public health legislation ought to be sacred, entirely our business! We
have heard, ad nauseam, how safe herbicide 2,4-D and other pesticides are–pesticides is a generic term applying to all the “cides”, but we are talking here mainly about herbicides and insecticides. The ndustry
has a very close relationship–too close–with Health Canada’s Pest Management Regulatory Agency (PMRA). There is only one epidemiologist on staff and no meaningful capability to examine peer-reviewed human
studies that are provided to the industry by independent scientists. Thus PMRA’s registrations of chemical products, such as herbicide 2,4-D, is based almost exclusively on rat data provided by the industry. Such data are incomplete. PMRA is not provided with information on birth defects, immune disruption and contaminants such as dioxin, a random
product of herbicide manufacturing. Instead of going forward, the PMRA has reverted to its previous practice of calling pesticides “safe” when used according to the label. Adhering to the label protects the applicator, but in no way removes the toxic exposures of young children, which is especially harmful when residues are absorbed via inhalation rather than mouth as they go directly to the brain, by-passing the liver which is the cleansing organ. Common herbicide 2,4-D’s first breakdown product, untested by the industry, is more toxic than the original herbicide. It is absolutely essential that 2,4-D be banned and it is not
enough to restrict its ban to use of weed & feed, i.e. 2,4-D product, and to homeowners alone, as announced in Alberta. The application of 2,4-D by so-called “professionals” does not render it any less toxic.
